Skilled Independent Visa – Subclass 189

Skilled independent visa 189 is a skill and point-based visa granted to people willing to live and work permanently in Australia. This visa can be applied while staying in or out of Australia and doesn’t require the applicant to have a sponsor or nominator.

Eligibility to apply for Subclass 189 Visa

The eligibility criteria of the visa may vary based on the stream of application.

Points-tested stream

To be eligible for this stream, the applicant must:
Be under 45 years of age
Have a relevant occupation as per the Skilled Occupation List
Have a suitable skills assessment for the occupation
Be invited to apply
Score a minimum of 65 points
Have a competent level of English
Meet health and character requirements
Not have had a visa cancelled or a previous application refused

New Zealand stream

To be eligible for the New Zealand stream of Skilled Independent Visa 189, the applicant must: 
Have a New Zealand Special Category visa. They should have been staying in Australia for a minimum of five years and must have started living here on or before 19 February 2016.

Hong Kong Stream

This stream is for Hong Kong or British national passport holders only. To be eligible for this stream:
Applicant must have resided in Australia for a continuous period of at least 4 years before applying for this visa.
o Applicants must also have held a qualifying visa during the 4-year period.

Can I Apply in Australia or Overseas?

You can be in or outside Australia when you submit your EOI. You can either be in Australia or overseas when you apply for a Subclass 189 Skilled Independent Visa. To be able to lodge from within Australia, you would need to hold a substantive visa or a Bridging A, B or C visa. Once you apply from within Australia, you will receive a bridging visa allowing you to remain in Australia during processing of your visa application. If your current visa is refused or cancelled, you might not be eligible to apply for the 189 visa while you were in Australia.
